ORDINANCE NO. 2-2011
AN ORDINANCE TO AMEND ORDINANCE NUMBER 7-2007,
BEING THE ZONING ORDINANCE OF THE TO The SECTION 1. Article VI, Terminology and Definitions, at Section 602, Definitions, is amended at the following Sub-Section by the amendment of the following definition which shall hereafter read as follows: 602:6
F Fence
A fence is an enclosure and or barrier, which is constructed
or planted in whole or in part within ten (10) feet of the property line
for the purpose of denoting a boundary line between parties or to
visually create a barrier between adjacent parcels. SECTION 2. Article VI, Terminology and Definitions, at Section 602, Definitions, is amended at the following Sub-Section by the amendment of the following definition which shall hereafter read as follows: 602:6
F Fence, solid A solid fence is fence that is so constructed or planted such that more than fifty percent (50%) of the surface area, measured perpendicular to the sides, consists of material which is solid or opaque. Floating
Dock
A more or less rigid, free floating platform not attached to
the land, made of buoyant materials: a dock, raft, float, ski jump,
trampoline, swimming or diving platform. 602:9
I Ice Shanty
A shanty or tent type structure designed for fishing through
the ice. This may be a
portable or stationary type of structure. SECTION 3. Article IV, General Provisions, at Section 402, District General Regulations, Sub-Section 402:11 is amended and shall hereafter read as follows: 402:11 a. Floating docks or ice shanties shall have light reflecting devices at each corner or side of the above said items that makes them clearly visible during night-time hours by boaters and snowmobilers. Floating docks must also have a three (3) inch by five (5) inch permanent sign or placard that conspicuously identifies the current lake property name and address of the owner. Ice shanties must be identified according to the DNRE requirements, which state that the name and address of the owner must be on all sides of the shanty in legible letters at least 2 inches in height. The letters shall be readily visible and consist of material not soluble in water. The name and address must be on the shanty and may not be placed on a board or other material that is attached to the shanty. b. Any water related accessory structure such as a boathouse, shed or similar shall follow all rules and regulations of this Ordinance including setbacks, height restrictions, lot conditions. SECTION 4. Article IV, General Provisions, at Section 402, District General Regulations, Sub-Section 402:12 is amended and shall hereafter read as follows: 402:12
R-1 District Fences. Fences in the R-1 District must comply with the following. Fences may be installed on an individual property providing that the fence meets all set back and dimensional requirements of this ordinance. All fences require a land use permit. The maximum height of a fence is four (4) feet from the normal surface of the ground. Solid fences shall not be installed or erected closer than twenty-five (25) feet from the road right of way. On lake front properties solid fences shall not be closer than forty (40) feet from the nearest established water’s edge. SECTION 5. All ordinances and amendments thereto, in conflict with this ordinance area hereby repealed. SECTION 6.
This ordinance shall become effective eight (8) days after
publication thereof.
