Township of Secord

County of Gladwin, Michigan

AN ORDINANCE TO AMEND ORDINANCE NUMBER 7-2007, BEING THE ZONING ORDINANCE OF THE TOWNSHIP OF SECORD, COUNTY OF GLADWIN, MICHIGAN.

The Township of Secord, County of Gladwin, Michigan ordains, pursuant to the authority vested in it by Act 110 of 2006 of the Public Acts of the State of Michigan as amended, the following Amendment to the Secord Township Zoning Ordinance.

SECTION 1.

              Article VII, Administration and Enforcement, is amended at its Section 708, Violations and Penalties, which shall hereafter read as follows:

708 – Violations and Penalties.

Any person or other entity who violates any provision of this Ordinance, including the property owner and person or entity in possession or control, is responsible for a municipal civil infraction as defined by Michigan law and subject to a civil fine of not more that $500.00, plus costs, which may include all direct or indirect expenses to which the Township has been put in connection with the violation.  In no case, however, shall costs, of more than $500.00 be ordered.  In addition, all violations of this Ordinance or any part thereof are declared a nuisance per se.  The Township specifically reserves the right and shall have the authority to proceed in any court of competent jurisdiction for the purpose of obtaining an injunction, restraining order or other appropriate remedy to abate said nuisance and to compel compliance with this Ordinance.  Each day that a violation shall continue is to constitute a separate offence.

SECTION 2.

                All ordinances and amendments thereto, in conflict with this ordinance are hereby repealed.

SECTION 3.

                Unless prohibited by state law or unless otherwise provided by specific provisions of a particular Secord Township ordinance to the contrary, the following officials are here by designated as the authorized Township officials to issue and serve municipal civil infraction citations for violations of the Township ordinances which provide for municipal civil infraction for a violation thereof:

                The Gladwin County Sheriff and all other deputy county sheriffs of said county

                The Township Supervisor

                The Township Enforcement Officer

                The Township Zoning Administrator

                The Township Clerk

SECTION 4.

                This ordinance shall become effective eight (8) days after publication thereof.  Adopted by the Township Board, Township of Secord, Gladwin County, Michigan at the meeting of the Township Board held on the fifteenth day of June 2011
