PERMITTED USES BY DISTRICT
301 A-1 District – Permitted Uses and Structures

Within any A-1 District, no structure or premises shall hereafter be used, erected, converted or altered externally in whole or in part if said use is not in accordance with the intent of Section 201:1, this Ordinance, except as otherwise provided in this Ordinance, for any other than one or more of the following permitted uses.

301:1 Principal Uses and Structures – A-1 District

1 General farming including gardening, crop raising, nurseries and other similar agricultural activities.
2 Single family or a two (2) family dwelling including a mobile home provided that the wheels have been removed and structure is placed on an approved permanent foundation. See Section 402:4, this Ordinance.
3 Livestock farms, ranches, public or private riding stables, dairy farms and poultry farms provided there is no slaughtering, rendering, tanning or similar processing on the premises except for the private use of the processed product by the occupants.
4 Kennels. Any structure or outbuilding used, or intended for use as a kennel for dogs or cats, shall be located at least twenty five (25) feet from any property lines and shall be fenced and/or otherwise screened such that the animals which occupy the kennel shall not be visible from adjacent property or the thoroughfare. Kennels shall be anyplace, whether licensed for such purpose or not, wherein dogs or cats are bred, boarded or trained for hire, for a valuable consideration, or where more than four (4) dogs or cats are customarily harbored, all other than wholly within a dwelling also generally used for human habitation.
5 Cemeteries.
6 Recreational areas both year-around and seasonal, public or private, including but not limited to: golf courses, athletic areas, playgrounds, auditorium and theaters.
7 Timber and tree products production only from trees harvested upon the premises and provided that all related structures and fixed equipment shall be located a minimum of one hundred (100) feet from all property lines.
8 Religious institutions; churches, synagogues, temples, etc.
9 Schools, either public or private not operated for a profit.
10 Governmental administrative buildings.
11 Warehousing without storage yards.
All principal uses and structures in the A-1 District shall be subject to the area, location and height restrictions as specified on the accompany SCHEDULE OF A-1 DISTRICT REGULATIONS or to more restrictive laws, regulations or codes which are legally in force.
301:2 Accessory Uses and Structures – A-1 District

1 Private garages and carports.
2 Home occupations.
3 Farm buildings, with or without storage yards, when located a minimum of fifty (50) feet from all property lines.
4 Stands for display or sale of agricultural products raised on the premises provided that there shall be no more than one (1) stand for each premises and also provided that the size of any such stand shall not exceed four hundred (400) square feet in floor area.
5 Clubhouses and other similar structures accessory to the principal recreational use.
6 Outside storage of major recreational equipment including or similar to campers, boats, travel trailers, snowmobiles, etc. provided that said equipment shall be unoccupied and owned by property owners.
7 Any other accessory uses and structures which are similar to the above listed accessory uses and structures and which are customarily incident to any of the principal uses and structures.
8 Enclosed or covered decks and porches, which are associated with any structure, shall maintain required setbacks as specified in the Schedule of District Regulations for the appropriate District. Enclosed would include decks or porches with partial or total privacy walls or privacy fences around them.
All accessory uses and structures in the A-1 District shall be subject to the area, location and height restrictions which are applicable to the principal use to which they are incident and as specified on the accompanying SCHEDULE OF A-1 DISTRICT REGULATIONS or to more restrictive laws, regulations or codes which are legally in force.

301:3 Special Uses and Structures A-1 District

1 Multiple family dwellings.
2 Retail sales establishments.
3 Personal service establishments.
4 Hotels or motels.
5 Rooming houses.
6 Clubs or lodges.
7 Mobile home parks.
8 Travel trailer parks and campgrounds.
9 Sanitary landfill.
10 Public utility facilities without storage yards.
11 Radio and/or television stations with or without storage yards.
12 Warehousing and storage yards excluding the storage of inoperable mechanical equipment.
13 Junk yards.
14 Manufacturing facilities.
15 Auto repair including body shop.
16 Yard Sales.
All special uses and structures in the A-1 District shall be subject to all restrictions, regulations and conditions as specified in Section 501 of this Ordinance or to more restrictive laws, regulations or codes which are legally in force.

All principal uses, accessory uses and special uses in the A-1 District shall be subject to the conditions of the Special Regulations for On-Site Parking as specified in Section 503 of this Ordinance.

Within any R-1 District, no structure or premises shall hereafter be used, erected, converted or altered externally in whole or in part if said use is not in accordance with the intent of Subsection 201:2, this Ordinance, except as otherwise provided in this Ordinance for any other than one or more of the following permitted uses.

302:1 Principal Uses and Structures – R-1 District

1 Single family and two family dwelling (including approved mobile homes). See Section 402:4, this Ordinance.
2 Governmental administrative buildings.
3 Schools, either public or private not operated for a profit.
4 Public medical and health facilities.
5 Recreational and social facilities either public or private including theaters and auditoriums.
6 Religious institutions: churches, synagogues, temples, etc.
7 Cemeteries.
All principal uses and structures in the R-1 District shall be subject to the area, location, and height restrictions as specified on the accompanying SCHEDULE OF R-1 DISTRICT REGULATIONS or to more restrictive laws, regulations or codes which are legally in force.
302:2 Accessory Uses and Structures – R-1 Districts

1 Private garages, carports, pole barns and sheds.
2 Private swimming pools.
Playground equipment.
4 Home occupations.
5 Clubhouses and other structures accessory to the principal recreational use.
6 The keeping of not more than two (2) roomers or boarders by a resident family.
7 Semi trailers, buses, mobile home shall not be used for storage purposes.
8 Enclosed or covered decks and porches, which are associated with any structure, shall maintain required setbacks as specified in the Schedule of District Regulations for the appropriate District. Enclosed would include decks or porches with partial or total privacy walls or privacy fences around them.
9 Portable carports, lean-tos, sheds attached to any structure: side-walls to enclose structures must be Of-like-materials. Existing carports, lean-tos, sheds with existing tarps and other material, when upgrading or repairing must be replaced with material similar to structure; may require a Land Use Permit.
10 Any other accessory uses and structures which are similar to the above listed accessory uses and structures and which are customarily incident or any of the principal uses and structures.
All accessory uses and structures in the R-1 District shall be subject to the area, location and height restrictions which are applicable to the principal use to which they are incident and as specified on the accompanying SCHEDULE OF R-1 DISTRICT REGULATIONS or to more restrictive laws, regulations or codes which are legally in force.
302.3 Special Uses and Structures – R-1 District

1 Multiple family dwellings.
2 Rooming houses.
3 Hotels or motels.
4 Homes for the elderly.
5 Clinics.
6 Clubs or lodges.
7 Nursing Homes.
8 Public utilities facilities without storage yards.
9 Retail sales facilities.
10 Personal service facilities.
11 Mobile home parks.
12 Travel trailer parks and campgrounds.
All special uses and structures in the R-1 District shall be subject to all restrictions, regulations and conditions as specified in Section 501 of this Ordinance or to more restrictive laws, regulations or codes which are legally in force.

All principal uses, accessory uses and special uses in the R-1 District shall be subject to the conditions of the Special Regulations for On-Site Parking as specified in Section 503 of this Ordinance.

C-1 District – Permitted Uses and Structures
A. General
  Within any C-1 District, no structure or premises shall hereafter be used, erected, converted or altered externally in whole or in part if said use is not in accordance with the intent of Subsection 201:3, this Ordinance, except as otherwise provided in this Ordinance for any other than one or more of the following permitted uses as defined in section 303 Permitted Uses and Structures.
  B. Preliminary Site Plan Review:
  1. Before any work is done on the site the applicant must submit a “Preliminary Site Plan” to the Planning Commission for review. This preliminary plan should include basic concepts of the total project such as: the purpose and number of buildings, building sizes, type of construction, basic site layout, parking, signage, lighting etc.

2. The review of a preliminary plan does not grant any approval of an application; a preliminary plan must still be followed by submission of a final site plan for approval.
  C. Final Site Plan Review:
  1. Before any work is done on the site the applicant must submit a “Final Site Plan” to the Planning Commission for review. This final site plan must include all relevant details, such as locations and sizes of utilities, landscaping material and planting details, sign locations and sizes, clearly defined access points, precise building sizes, locations and uses, floor plans, lighting plan, fencing plan, landscape plan and other detailed elements.

2. Final site plan approval allows the applicant to construct the project according to the approved plan.
  D. Site Plan Expiration:
  If substantial construction beyond clearing the property or other minor changes has not begun within one year of approval of the Final Site Plan the Site Plan approval expires. Should construction not be substantially underway by the expiration, the site plan approval must either be extended or a new request for approval submitted to the Planning Commission. The Planning Commission may grant an extension of the site plan approval, but they are not required to do so and may request a new submission before work can begin or be continued.
  E. Parking:
  All principal uses, accessory uses and special uses in C-1 District shall be subject to the conditions of the Special Regulations for On-Site Parking as specified in Section 503 of this Ordinance.
  F. Signs:
  All signage must comply with Article IV – General Provisions, Section 401:12 Signs.

3 Offices.
4 Public utilities facilities with or without storage areas.
5 Dwelling units when located only on the second floor above another principal use.
6 Financial institutions.
7 Marina facilities.
8 Gasoline service stations.
303:2 Accessory Uses and Structures – C-1 District

1 Signs, when announcing the product or service offered on that zoning lot.
2 Storage buildings and storage yards.
3 Enclosed or covered decks and porches, which are associated with any structure, shall maintain required setbacks as specified in the Schedule of District Regulations for the appropriate District. Enclosed would include decks or porches with partial or total privacy walls or privacy fences around them.
4 Any other accessory uses and structures which are similar to the above listed accessory uses and structures and which are customarily incident to any of the principal uses and structures listed above.
303:3 Special Uses and Structures - C-1 District

1 Warehousing
2 Auto repair, including body shops.
3 Manufacturing facilities.
4 A single family dwelling unit when located only on the second floor above another principal or special use.
303:4 Schedule of C-1 District Regulations
 
All principal and accessory uses in the C-1 District shall be subject to the following area, height and location regulations.
1 Minimum lot area – 1 acre
2 Maximum height – thirty-five (35) feet.
3 Minimum yards – Front yards – 40 feet
Rear yard – 40 feet
Side yards – total of 25 feet not less than 10 feet on either side
