Meeting called to order by Supervisor Colin Combs at 10:00 am with everyone standing and reciting the Pledge of Allegiance.
Roll Call: Taken by Clerk Kathy Wilton as follows: Supervisor Colin Combs present, Treasurer Mickey Hetherington present, Clerk Kathy Wilton, Trustees Martin Holmes and Bill Bowman were present. 21 interested residents were in attendance.
Public Comment: none
Correspondence: Wilton read the following correspondence: Letter from Charter about channel line-up changes, Board of Review minutes, Road Commission meeting dates.
Minutes of December 20, 2017 regular meeting were reviewed. Motion by Holmes/Hetherington to accept as presented. all ayes M/C
Treasurer’s Report: Report was read by Treasurer Hetherington as follows:

Bills to be paid: Wilton read the following bills to be paid: General fund $37,658.63, Fire Fund 3,910.31 and payroll 7,395.00 Motion by Combs/Hetherington to pay the bills as presented. All ayes. M/C
Guests:
County Commissioner Sandra Aultman: Reported the drain commissioner needs a new secretary, Equalization needs help due to Kim's sprained ankle, Tara Hovey, county attorney, is looking at what can be done with drain commissioner issues, budget has been approved, county clerk has written 2 grants for vehicles, and a millage increase will be on the fall ballot for Council on Aging. Wilton asked why the Sheriff got a $10,000 raise and the Undersheriff got a $7500 raise but the Clerk, Treasurer and Registrar of Deeds only got $500.00 each. Aultman stated everyone got something.
Berg Assessing: Assessor Alan Berg reported everything has been finished for Board of Review, there were 2 tax tribunal cases and they are waiting for a decision, he is waiting on numbers from equalization and time is of the essence. The 20% of the township inspections have been completed and building permit follow-up are getting done.
County Leadership Program: Terina Barta made a presentation for a Little Free Library to be set-up in Secord Twp. They are looking at a couple of locations and when one is determined they will get back with us. This would be no cost to the township and have a free book exchange available to residents.
Committee Reports:
Planning Committee: Rex Rowe, chairman of the planning committee, presented a property line adjustment for Judy Boman. Motion by Combs/Holmes to allow adjustment with Allan Berg setting up the new property identification. All ayes M/C Solar farm ordinances are being addressed and corrections on spelling is being worked on for the entire set of ordinances. There will be a new table of contents done also for clarification.
Fire Board: Chairman Marty Holmes reported: 15 runs last month and 8 were rescues with 7 fire calls.
Fire Chief: Fred Shaver reported the tanker is going to Gaylord for the day to fix a recall issue, trailer in trailer park needs and eviction and to be torn down, they are addressing the trailer that runs a generator constantly.
Constable: Kathie Hart turned in the report.
Road Committee: none
Zoning Administrator: Still busy. 1 permit issued for 2018 so far. Still receiving a lot of calls.
Ordinance Officer: Working on blight issues in the trailer park with owner Mr. Davis.
Well and Septic report: Bowman reported 1 person upset about the ordinance but the health dept has no record of their well or septic and no one knows where it is on the property. He is working with the owner and the health dept so they can sell the property.
Other Business:
Garbage Assessment: Hetherington/Comb moved to take assessment off 130-015-302-001-00. All ayes. M/C Discussion on curbside recycling. We will hold a public hearing on Saturday, February 24th at 10am to discuss the update on the ordinance and curbside recycling.
Title Search: Wilton shared the information from NorthStar Title on township owned property on Lakeshore Dr. There are 3 pieces of property and each has a different title wording and description. We will send to attorney to advise what we can do with the property to take it out of the township’s hands.
Marijuana Ordinances: Resolution 2018-1 offered by Combs/Hetherington to opt out of medical marijuana facilities. Roll Call vote: Hetherington yes, Combs yes, Wilton yes, Bowman yes, Holmes yes.

Small welcome signs: Combs stated the signs are $25 each. Locations are being determined.
Blight in Mobile Home Park: Combs stated he is working on it with the attorney.
Board of Review: All went well.
Resolution 2017-9: This is combination of several blight structures.

Township of Secord
County of Gladwin, Michigan

Title: The Secord Township Blighted Structure Ordinance
AN ORDINANCE TO PREVENT REDUCE OR ELIMINATE BLIGHTED STRUCTURES WITHIN THE TOWNSHIP AND TO SECURE THE PUBLIC HEALTH, SAFETY AND GENERAL WELFARE BY PROHIBITING THE MAINTENANCE OF SUCH STRUCTURES.

NOW THEREFORE, THE TOWNSHIP ORDAINS:

Section 1. Title

This ordnance shall be known as the “Secord Township Blighted Structure Ordinance”. (Referred to herein as “This Ordinance).

Section 2. Definitions

Blighted Structure includes, without limitations, any dwelling, garage, out-building, warehouse, or any accessory structure or part of a structure which because of fire, wind or other natural disaster, physical deterioration, demolition or partial demolition when said demolition is not carried out within a reasonable period of time, is no longer habitable as a dwelling, nor useful for the purpose for which it may have been intended, or has uncovered openings which may provide unrestrained access to enter the structure.

Section 3. Unlawful to Cause Blighted Structures

No person, owning or occupying any lot or land within the Township shall maintain any blighted structure on said lot or land except upon the premises of a licensed or approved junk dealer, junk buyer, or dealer in second had goods or junk for sale.

Section 4. Declaration of Nuisance

The presence of a blighted condition on any platted or unplatted parcel of land is in violation of the terms of This Ordinance and is hereby declared a public nuisance per se.

Section 5. Notice to Remedy Conditions

Upon the discovery of a prohibited condition existing as set forth in This Ordinance, the Township Enforcement Officer or the duly authorized representative of the Township of Secord shall notify the owner of the property of such condition and require that it be remedied within ten (10) calendar days. The notification may be given in person, or by first class mail, addressed to the last known address of the property owner, or by posting the premises.

Section 6. Failure to Remedy Prohibited Condition Lien

Should the owner fail to remedy the condition after notice as described herein, This Ordinance. The Township Enforcement Officer of the duly authorized representative of the Township of Secord may remedy the condition or cause the same to be done by personnel of the Township or by private contractor and the actual cost of the remedying the prohibited condition plus 10 % for inspection and overhead and other additional costs in connection therewith, shall be collected as a special assessment against the premises as provided in the statutes and shall become a lien against the property. Levying or collecting such a special assessment shall not relieve any person offending against This Ordinance from the penalty prescribed for the violation of same.

Section 7. Violation

Any person or other entity who violates any provision of This Ordinance, including the property owner and person or entity in possession or control, is responsible for a municipal civil infraction as defined by Michigan law and subject to a civil fine of not more than $500.00, plus costs, which may include all direct or indirect expenses to which the Township has been put in connection with the violation. In no case, however, shall the costs, of more than $500.00 be ordered. In addition, all violations of This Ordinance or any part thereof are declared a nuisance per se. The Township specifically reserves the right and shall have the authority to proceed in any court of competent jurisdiction for the purpose of obtaining an injunction, restraining order or other appropriate remedy to abate said nuisance and to compel compliance with This Ordinance. Each day that a violation shall continue is to constitute a separate offence.

Section 8. Repealer

All ordinances and amendments thereto, in conflict with This Ordinance are hereby repealed.

Section 9. Severability

The provisions of This Ordinance are hereby declared to be severable, and if any clause, sentence, paragraph, section or sub-section is declared to be void or ineffective for any reason, it shall not affect any other part or portion hereto.

Section 10. Effective Date

This Ordinance shall become effective thirty (30) days from the date of publication in a newspaper in general circulation within the Township of Secord.

CERTIFICATION

The above Ordinance Number 2017-9 was adopted at a meeting of the Secord Township Board on the twentieth day of December 2017, and published in the Gladwin County Record, a newspaper of general circulation in the Township of Secord on the twenty seventh day of December 2017.

911 Meeting: Combs reported everything is going well.
Corrective Action Plan: Corrective plan needed by state treasury for our audit. Wilton presented plan. Motion by Wilton/Hetherington to allow auditors to send plan. All ayes. M/C
